Terms and Conditions. Terms and conditions for GHOSTPHRASE 1. General 1.1 HJALT Computing provides the software GHOSTPHRASE (called GP in this document), which is an independent encryption program intended for email. Most email clients can send and receive the encrypted files. HJALT Computing does not guarantee that GHOSTPHRASE will work with every email software client. GHOSTPHRASE Services and password manager GOTHPASS are also encompassed by the terms for GP. 1.2 GHOSTPHRASE runs on Windows 98, 2000, XP. 1.3 GHOSTPHRASE is intended to protect personal integrity and private information, as well as company secrets, and sensitive legal, political, state, and military information. 1.4 The person or organization purchasing and/or using or downloading GP, or using information or links provided on ghostphrase.com or on printed material provided by HJALT Computing, is named "Customer" in this document. 1.5 It is the Customer's responsibility to stay informed about these terms, as posted on www.ghostphrase.com or on www.HJALTComputing.com. 1.6 It is the Customer's responsibility to follow the instructions for use for GP. 1.7 The GHOSTPHRASE CORPORATE services and products are for logistic reasons currently limited to only the following countries: Iceland, Norway, Sweden, Finland, Ireland, United Kingdom, Denmark, The Netherlands, Belgium, France, Poland, Germany, Spain, Portugal, Switzerland, Italy, Luxemburg, Greece, Austria, United States of America, and Canada. Each CORPORATE version of services and products may be covered in special terms and conditions determined by negotiations between HJALT Computing and the Customer. 1.8 External links. Links to other Internet sites are provided for reference only and for the convenience of users. HJALT Computing is not responsible for the availability or content of these external sites, nor does HJALT Computing endorse, warrant, or guarantee the products, services, or information described or offered at these other Internet sites. Users cannot assume that the external sites will abide by the same Privacy Policy to which HJALT Computing adheres. It is the responsibility of the user to examine the copyright and licensing restrictions of linked pages and to secure all necessary permissions and pay applicable fees. 2. Responsibilities of HJALT Computing 2.1 HJALT Computing is responsible for delivering GP software that function as described on ghostphrase.com. 2.2 HJALT Computing may compensate damages from legitimate claims to the maximal amount of USD 650. HJALT Computing is not responsible for any indirect damages or damages regarding a third party. HJALT Computing is not to be held responsible for any damages caused entirely or partially by the Customer, or by a third party. 2.3 If the Customer finds errors or damages on GP or related to advertisements or web sites, this shall be reported within 10 days to HJALT Computing or its representative. If the report has reached HJALT Computing within 10 days of the occurrence, and the damage or error can be attributed to HJALT Computing, HJALT Computing shall replace the GP product with a similar GP product, free of charge. HJALT Computing is not responsible for damages caused by a complaint or report beyond the time limit of 10 days. 2.4 HJALT Computing is not responsible for damages caused by enforcements by law or authorities, acts of war, strike, blockade, boycott, lock-out, or similar force majeure, out of control by HJALT Computing. Damages caused by other ways will not be reimbursed by HJALT Computing. HJALT Computing is not responsible for any indirect damage or injury. 3. Responsibilities of the Customer. 3.1 The responsibilities of HJALT Computing are described above under section 2. Thus, the responsibilities of the Customer are for example: 3.2 The Customer is responsible for use of GP in a way consistent with international law and conventions. 3.3 The Customer shall protect the User password for each copy of a GP product. The User password cannot be altered by the Customer. 3.4 The Customer is responsible for creating, remembering/storing, update, protect, and if needed distribute the other keys, the Link password and the Message Key. For the CORPORATE version, the Customer can get limited help with distribution of Message keys and internal keys from HJALT Computing. Lost, stolen, or forgotten passwords or keys will NOT be replaced or obtained from HJALT Computing or any of its representatives. 3.5 The Customer is responsible for the use of GP in a way that does not directly or indirectly injure, kill, or insult humans or animals, or cause material or other damages. 3.6 The Customer downloads, installs and uses the software GP at own risk. The Customer uses information from ghostphrase.com at own risk. The Customer is responsible for that use of GP does not cause conflicts with other software or causes loss of vital information. 3.7 The Customer is responsible for safe handling of passwords, keys, and internal keys for GP. 3.8 The Customer is responsible for safe distribution to his/her/its contacts of all applicable keys and passwords. 3.9 The Customer cannot market GP as the Customer's product or service. 3.10 The Customer may not de-compile, reverse engineer, steal source code or in other ways copy the functions of GP to the Customer's own product or service without prior agreement with HJALT Computing. 3.11 Payment. The Customer has to pay for those versions of GP that are not freeware; GOLD, SILVER, SILVER SUBSCRIPTION, and CORPORATE, according to the current price list. Payment for GP products is either made in advance by credit card via external links to companies handling such payments, or by bank wire transfer. Payments can also be accepted after the delivery of a GP product, by billing the Customer. Such bills must be paid by the Customer within 20 days. An interest of 5% per month will be added to the Customers bill, starting the day after the original bill deadline. 3.12 It is the Customer's responsibility to stay informed about these terms, as posted on www.ghostphrase.com or on www.HJALTComputing.com. 3.13 It is the Customer's responsibility to follow the instructions for use for GP. 3.14 The Customer must be authorized to make purchases. 4. Consent to storage of personal information. 4.1 HJALT Computing will get access to limited information for paying Customers of GP. These can include name, address, email address, VAT number, telephone number, and credit card numbers. HJALT Computing stores such information in the customer records. 4.2 HJALT Computing does not trade, give, or sell such personal information, but may have to share this with authorities according to Swedish and European Union laws. 4.3 Customers can request a copy of their own data stored in the customer records. 5. Software, domain names, and web sites. 5.1 Software, domain names, web pages, images, text, trade marks, and other copyrighted or otherwise proprietary items presented by HJALT Computing or its representatives are owned by HJALT Computing, and may not be used by the Customer or any one else in any way without prior explicit agreement with HJALT Computing. 6. Maintenance of GP 6.1 HJALT Computing reserves the right to temporarily close ghostphrase.com due to maintenance, or during disturbances, or if it according to HJALT Computing is needed for whatever reason. 7. Changes in Terms and Conditions. 7.1 HJALT Computing reserves the right to make any kind of change in these conditions at any time. The new Terms and Conditions will be in effect 3 days after posting on ghostphrase.com or HJALTComputing.com. The Customer has the right to receive from HJALT Computing a printed copy of the current Terms and Conditions by contacting HJALT Computing. 8. Disputes. 8.1 Disputes regarding these Terms and related issues will be tried in a Swedish court of law according to Swedish law. COPYRIGHTS 2005-2007 TORD HJALT and HJALT Computing.
